Terms & Conditions - Island Tours Mallorca
At the start of the tour, a short briefing will be provided for all tour participants. It is
mandatory to attend this briefing and to follow these instructions. To avoid
misunderstandings, the following conditions have been stated for participations on the tour.
General
– The driver must be in possession of a valid driver’s license (at least category B
passenger car) for at least 2 years.
– The driver adheres to the traffic rules for driving on or in a motorized vehicle on
bicycle paths, public roads and other areas.
– Drivers are obliged to follow the instructions given from the Island Tours Mallorca
employee/guide regarding driving on/in the vehicles and the route to be driven.
– Drivers must wear closed shoes. Driving with flip-flops/sandals is prohibited by law.
– Participants may not cause nuisance to other participants, road users, persons, nature
or animals in the area.
– Participants must inform Island Tours Mallorca about any health problems of the
client. Pregnancy, surgery and other implications must be reported to the organization
at the booking section and before the start of the tour.
– Consumption of alcoholic beverages and/or narcotics is prohibited. Consuming
alcohol and/or narcotics before the start of the tour is prohibited. Suspected
consumption of alcohol and/or narcotics will lead to exclusion from the tour. In
addition, the consumption of alcohol and/or narcotics is prohibited during the tour.
Reservation
– Reservation of participation of the tour is made through the Island Tours Mallorca
website. The reservation is final when the payment has been received at Island Tours
Mallorca, after which a confirmation with further information is send to the email
address provided by the participant. As an exception it is possible that the excursion is
payed before the start of the excursion.
– After completing the booking, it is mandatory to comply with the conditions.
– Payment for the tour is only possible online through the Island Tours Mallorca
website.
– Reservation and payment of exclusive group excursions takes place through
telephone/email contact. The reservation is final when the payment is received.
Cancellation and modification of the booking
– Cancellation of the booking is only possible up to 72 hours before the start of the tour.
In this case, the full amount payed will be refunded to the customer.
– In the event of extreme weather conditions or other inconveniences that do not allow
to guarantee the quality of the tour, the tour may be canceled by Island Tours
Mallorca. In this case, the full amount will be refunded to the customer or other
arrangements will be made.
– Moving a booked and payed excursion to another date is possible to a limited extend
in consultation.
– In exceptions, it is possible to deviate from the above, such as serious illness or death;
in consultation another date/time will be agreed, or other arrangements will be made.
– Cancelation by Island Tours Mallorca is possible in exceptional cases such as force
majeure, for example because the vehicles are defective or unable to drive for other
reasons. In that case, Island Tours Mallorca will agree with the participants a new
date/time for the excursion, or if that is not possible, refund the payment.
Tour
– During the tour, the tour guide may decide to deviate from the planned route. It is not
possible for customers to claim part of the amount payed as a result of the tour guide’s
change of course.
– In case of reckless driving, endangering others, not following the tour guide’s
instructions and/or other violations, the tour guide may exclude the person concerned
from the tour.
Allocation of car seats
– Allocation of the cars to the participants is the responsibility of Island Tours Mallorca.
– When participating in a tour, an attempt will always be made to keep the booked
groups together.
– If there are fewer than 4 people participating, it is possible that other participants will
ride in the car with you, or that you will be assigned to another car. In exceptional
cases, it may happen that the group is not together and is divided over several cars.
– It is allowed to change drivers; anyone who takes a seat in the car (and is in
possession of a valid driver’s license for at least 2 years) and wishes to drive, has the
right to drive himself; the drivers must exchange between themselves at stop places
and must give anyone who wants to do so a chance to drive.
Car insurance and risk
– The vehicles are third-party insured. The participants themselves bear the risk of
damage to the vehicles during the rental period. The participant agrees to this risk
and is responsible for the costs of damage caused by him/her.
– At the start of the tour, all starting drivers will sign a statement and the driver’s
license will be shown and noted.
Risk of participation and responsibility
– Participation in an excursion organized by Island Tours Mallorca is entirely at your
own risk. Island Tours Mallorca is never liable for damage costs during an excursion,
to the driver, third parties, or goods.
– Island Tours Mallorca is responsible for the proper maintenance of the vehicles and
clear instructions. All tours are driven exclusively under the guidance of experience
guides.
Costs
– During the time that the renter has the vehicle, the costs for using the vehicle are
included in the rental price.
– Any costs other than costs of the use of the vehicle and/or driver/passenger are for the
account of the renter.
– The renter is responsible for any fines, transactions and administrative sanctions that
may be imposed on Island Tours Mallorca.
– If the tank is empty too early due to incorrect use/deviation from the route by the
participant, the costs for transporting the vehicle or ensuring that the vehicle can drive
again will be on behalf of the renter.
Damage
– The renter is liable for all damage caused to the vehicle during the tour and
consequential damage resulting therefrom, whether or not through fault of the
renter and whether this occurs in or out of force majeure, except insofar as such
damage is covered by the third-party liability insurance.
– The renter indemnifies Island Tours Mallorca against all damage caused by
passengers or third parties, for which Island Tours Mallorca was not able to provide
cover under the third-party liability insurance.
– If damage is caused to an Island Tours Mallorca vehicle, the driver will report this
immediately by telephone.
– Damage also includes loss and theft of the vehicle and associated parts of the
vehicle, such as keys.
– The damage will be assessed by Island Tours Mallorca and charged to the participant
if necessary.
– The renter is obliged to follow the instructions to be given by Island Tours Mallorca
and, if possible, to have an official loss report drawn up by the police. If the stated
instructions regarding this process are not followed, the renter will be held liable for
any damage incurred for this failure.
– In the event of theft of the vehicle, the renter is fully liable. This liability may not
exceed the current value of the vehicle, supplemented with any consequential
damage such as loss of income for Island Tours Mallorca.
Dissolution
– The Island Tours Mallorca guide has the right to dissolve the rental agreement
without legal intervention or to exclude the participant from the excursion, if in his
opinion the vehicle is not used carefully by the renter, or if the participation poses a
danger or causes nuisance to others
